Arbitration & Mediation

YARD Law Co. attorneys understand not only the significant benefits that arbitration can bring to a commercial dispute, but also when it is the appropriate course of action. We represent clients in both domestic and international arbitration, examining all aspects of the individual case to provide the best possible protection.

What is arbitration?

Arbitration is a form of alternative dispute resolution that allows parties to resolve a dispute outside the court system. It is single-instance, with parties submitting to a judge whose decision is binding and final.

Advantages of arbitration over litigation

  • Expert arbitrators with qualifications in the specific field
  • More economical than traditional court proceedings
  • Faster dispute resolution procedure
  • Commercial flexibility
  • Confidentiality preserved
  • Easier international enforcement via the New York Convention (1958)

When is arbitration appropriate?

Arbitration is particularly suitable for: high-value commercial disputes, matters requiring specialist technical or industry expertise, cases where confidentiality is important, and international disputes where enforcement across borders is a consideration.

Mediation

We also assist with mediation - a voluntary, flexible process where a neutral third party facilitates negotiation. Often the fastest and most cost-effective resolution route for disputes where the ongoing relationship between parties matters.
