Purchasing property in Bulgaria is a significant investment - often made under pressure from deadlines, deposits, and expectations. Many buyers mistakenly believe that having a notary present is sufficient protection. In reality, a notary certifies the transaction; they do not protect the buyer's interests. We do.

What legal due diligence involves

A legal property review aims to establish whether a property can be acquired without legal or financial risk. It includes:

  • Verification of ownership and its history
  • Identification of mortgages, injunctions, court disputes, or other encumbrances
  • Property status and building permit validity
  • Verification of correspondence between documents and actual condition
  • Identification of third-party rights
  • Verification of the seller's authority to act

  • Unclear or broken ownership chain
  • Mortgages, injunctions, or pending court proceedings
  • Illegal or partially illegal construction
  • Discrepancy between actual condition and documents
  • Sale by persons without authority to act
  • Issues with ideal shares or land

Preliminary contract and deposit - a critical moment

Signing a preliminary contract without legal advice is one of the most common and most costly mistakes. Such contracts often contain clauses placing the buyer at a disadvantage: loss of deposit for minor breach, unclear or one-sided deadlines, no real protection if the seller defaults.

Foreign buyers

Foreign buyers face additional considerations:

  • Restrictions on acquiring land (non-EU citizens may need to set up a Bulgarian company)
  • Language and document barriers
  • Coordination between the transaction, residence status, and address registration

Why the notary is not enough

The notary does not conduct full legal due diligence in the buyer's interest; does not analyse economic and legal risk; does not negotiate contract terms; does not represent one side. We do all of this - exclusively in your interest.
